This document is intended to reflect industry best practices and current federal and
North Carolina requirements for firearms commerce and gunsmithing. It should be
reviewed by your attorney before publication. Nothing here is legal advice.

 


1) “Site”: our ecommerce website and any related apps or
services.
● “FFL”: a Federal Firearms Licensee.
Definitions
● “Company,” “we,” “us,” “our”: Sparks Precision Arms LLC.

● “Firearm”: as defined at 18 U.S.C. § 921(a)(3). Legal Information Institute
● “NFA Item”: silencer/suppressor, short-barreled rifle or shotgun, machine gun, AOW, or
destructive device under 26 U.S.C. Chapter 53. Legal Information Institute
● “PMF”: a privately made firearm, including frames/receivers subject to ATF Final Rule

2) Eligibility to Purchase


By placing an order you certify that:
1. You are at least 21 to purchase a handgun, handgun-only ammunition, or a
frame/receiver; 18 to purchase a rifle/shotgun or their ammunition, subject to stricter

2. You are not a prohibited person under 18 U.S.C. § 922(g) or other applicable law.

3. You will complete any required background check (NICS) and Form 4473 before
transfer. ATF
4. You will comply with all state/local restrictions where you reside and where transfer
occurs (e.g., magazine limits, feature bans, waiting periods, local ID requirements).
3) Federal Compliance Summary
● Form 4473 & NICS: All retail transfers to nonlicensees require a completed ATF Form
4473 and a background check unless a statutory exception applies. ATF
● Interstate sales: We may not sell and deliver a firearm directly to an out-of-state
nonlicensee. For out-of-state customers, the firearm must ship to an FFL in the
customer’s state for transfer; over-the-counter long–gun sales to nonresidents must
comply with both states’ laws. ATF
● Shipping: Handguns are not mailable via USPS. Carriers must be notified of firearm
contents; packages cannot be marked to indicate firearms. ATF+1
● PMFs / Frames & Receivers: We will not accept, transfer, or return a PMF that lacks
required markings or that otherwise violates ATF Final Rule 2021R-05F. North Carolina

4) North Carolina–Specific Requirements
● Safe-storage notice to purchasers: Upon retail sale or transfer in NC, we will provide
the buyer with the statutory safe-storage notice and post the required sign at each
purchase counter, in the format and prominence required by G.S. 14-315.2 (as

● Pistol purchase permit: North Carolina’s pistol purchase permit requirement was
repealed in 2023 (S.L. 2023-8). Standard federal background-check rules still apply.

5) Ordering & Custom Builds (Gunsmithing and New
Firearms)
1. Quotes and deposits: Quotes are estimates. Custom work or made-to-order firearms
may require a non-refundable deposit of [25%–50%] applied to the final invoice.
2. Lead times: Estimated lead times are good-faith and may change due to parts
availability, vendor delays, or regulatory holds.
3. Customer obligations: You agree to promptly (a) name a receiving FFL for transfers
and (b) pay the remaining balance when notified your firearm is ready to ship or pick up.
It is common industry practice to require pickup within 30 days of dealer delivery and to
treat failure to pass a background check as a buyer issue rather than seller error.
4. Design variance: Minor non-functional variations can occur due to tolerances and part
substitutions of equivalent or higher quality.
6) Gunsmithing Intake, Test, and Return
● Check-in: We record all incoming firearms in our A&D (bound) book. Provide a
government-issued photo ID.
● Safety evaluation: We may refuse unsafe work requests (e.g., illegal conversions,
removal of required markings, or work that would compromise safety).
● Test-fire: You consent to test-firing with SAAMI-spec ammunition to confirm function.

● Return to same person: A gunsmith returning a repaired/customized firearm to the
same person from whom it was received does not require a Form 4473 or NICS. If
anyone else picks up, a 4473 and NICS are required. ATF+1
● Storage & abandonment: After [60] days from completion notice, storage fees of
$[X]/week may accrue. Unclaimed firearms may be treated as abandoned as allowed
by law after documented notice attempts and may
7) FFL Transfers (Inbound/Outbound)
● Inbound to us: If another FFL sends a firearm for your transfer, ensure we receive their
license copy and your contact info. Transfer fees (standard and NFA) are posted
in-store and online.
● Outbound from us: We ship firearms only to FFLs (or back to the same individual for
repair returns). Adult signature is required. Handguns ship via carrier per their firearms
policy; long guns may ship carrier or USPS as permitted. ATF+1
● Compliance mismatches: If your order cannot legally be transferred in your jurisdiction,
we will cancel it and assess actual costs and a reasonable restocking fee.
8) Ammunition, HazMat, and Other Regulated Goods
● Ground service only for consumer shipments of most “Cartridges, small arms” under
49 CFR § 173.63 limited quantity provisions and carrier rules; no air shipments to
consumers unless specifically permitted. Additional HazMat handling may apply to
primers, powders, aerosols, lithium batteries, or tritium sights. eCFR+1
● Packaging/marking: We follow DOT/PHMSA rules for classification, packaging, and

9) Pricing, Payments, Taxes, and Fees
● Pricing: Posted prices are subject to change prior to order acceptance. Errors may be
corrected.
● Payment methods: We accept the payment types shown at checkout; some methods
may carry a processing surcharge capped at our actual cost of acceptance (where
permitted by law).
● Sales tax: Collected where required by law based on ship-to or pickup location.
● Transfer fees: FFL and NFA transfer fees are non-refundable once services are
performed or paperwork submitted.
10) Shipping, Risk of Loss, and Title
● Risk of loss passes to you upon delivery to your selected receiving FFL (or to you for
non-firearms shipments) per carrier scan records.
● Inspection: Inspect packages upon receipt. Report shipping damage to the carrier and
us within 48 hours.
● Delivery windows: Transit times are estimates; force majeure events (weather, carrier
delays, regulatory holds) are outside our control.
11) Returns, Cancellations, and NICS Denials
● Firearms and receivers: All sales are final once the transfer is completed (after you
complete 4473/NICS with your receiving FFL). Prior to transfer, returns are at our
discretion and subject to inspection, actual shipping, and a [10%–20%] restocking fee.
● Custom work: Deposits and labor on custom builds are non-refundable once work
begins.
● Accessories & apparel: Unused, unopened items may be returned within 30 days with
proof of purchase; a [15%–20%] restocking fee may apply and shipping is
non-refundable. (These windows and fees are consistent with common firearms-industry
practices.)
● NICS denial/undetermined: If you are denied or cannot complete transfer within [30]
days of dealer delivery, we will cancel and refund minus actual shipping, transfer, and a
restocking fee; custom deposits are forfeited if applicable. Industry examples often
require pickup within 30 days and treat failed checks as buyer responsibility
12) Warranty & Disclaimers
● New products: Manufacturer warranties apply; we assist with warranty claims as a
courtesy.
● Gunsmithing warranty: We warrant our workmanship for [12] months from completion
against defects in materials and labor on the specific work performed.
● Exclusions: Normal wear, cosmetic finish wear, improper maintenance, modifications by
others, corrosion, use of incorrect caliber, over-pressure or out-of-spec ammunition,
and reloaded/remanufactured ammunition are excluded. We test with SAAMI-spec

● Safety: Firearms are inherently dangerous. You agree to follow all safety rules, receive
competent training, and use only appropriate ammunition and accessories.
13) Safety, Storage, and Training
● NC required notice: We provide statutory safe-storage warnings and post the required
signage at purchase counters as described in G.S. 14-315.2. ATF+1
● Home storage: Always store firearms inaccessible to unauthorized persons, especially
minors. Consider safes, locked cabinets, and cable-style locks.
● California customers: If a product is shipped to or sold in California, you may see a
Proposition 65 warning for lead exposure (ammunition and some shooting products).

14) Export Control & Sanctions Compliance
● We do not export firearms, parts, optics, or technical data without proper authorization.
Items may be controlled under the ITAR (22 C.F.R. parts 120–130; State/PM-DDTC) or
the EAR (15 C.F.R. parts 730–774; Commerce/BIS). You agree not to export, re-export,
or transfer items or technical data in violation of U.S. law and to truthfully identify end

15) Prohibited Conduct
You may not request or direct us to perform, ship, or facilitate:
● unlawful possession or transfer;
● obliteration or alteration of serial numbers;
● manufacture/transfer of NFA items without proper ATF approval;
● straw purchases or false statements on 4473;
● unsafe modifications.
(FFLs must maintain records and may not transfer to prohibited persons or across state lines

16) Privacy
Use of the Site is subject to our Privacy Policy. For regulatory and anti-fraud purposes we may
retain transaction and identity information as required by federal and state law (e.g., records
retention under 27 C.F.R. part 478). eCFR
17) Limitation of Liability
To the maximum extent permitted by law:
● We are not liable for incidental or consequential damages arising from misuse,
unauthorized modifications, failure to follow instructions, or third-party acts.
● Our total liability for any claim relating to a purchase or service is limited to the amount
you paid for that purchase or service.
Some jurisdictions do not allow these limits; your rights vary.
18) Dispute Resolution; Governing Law
● Governing law: North Carolina law, without regard to conflicts principles, and applicable
federal law.
● Arbitration: Except for small-claims court or equitable relief, disputes will be resolved by
binding arbitration on an individual basis; no class actions. Filing location: Craven
County, NC; rules: [AAA/JAMS]. You may opt out by written notice within 30 days of
acceptance of these Terms.
19) Intellectual Property; Site Use
Website content, trademarks, and product imagery are owned by us or our licensors and may
not be copied or used without permission. Accounts may be suspended for violations, fraud,
abuse, or chargebacks.
20) Accessibility
We aim to comply with WCAG 2.1 AA for our Site. If you need an accommodation, contact

21) Changes to These Terms
